Terms of Use
The agreement between you and Mindful Innovations when you use our sites, tools, products, and services.
Last updated: October 2, 2026
1. Agreement
By using mindfulin.com and our related websites, tools, products, and services (together, the "Services"), you agree to these Terms and to our Privacy Policy. If you're using the Services for an organization, you confirm you're allowed to accept these Terms for it. If you don't agree, please don't use the Services.
2. Who we are
The Services are provided by Mindful Innovations, LLC, a Minnesota company, founded by Michelle Swerin, MA, LPCC. Mindful:In, mindful:spc (MindfulSPC), Mindful:ON, Mindful Edit, AIRRI, ALLIND, ACT, ACCESS, and MESH are brands and programs of Mindful Innovations.
3. Not clinical care
Our websites, assessments, audits, readiness checks, courses, toolkits, media, playlists, events, products, and consulting are educational and practical design resources. They are not psychotherapy, counseling, medical care, diagnosis, or treatment, and they are not a substitute for care from a licensed professional. Using them doesn't create a therapist–client or other clinical relationship with Michelle Swerin or anyone at Mindful Innovations.
Clinical services, where offered, are provided only after a separate intake, a separate informed consent and Notice of Privacy Practices, and only where the clinician is licensed to practice. Those clinical agreements, not these Terms, govern clinical care.
Talk with a qualified health professional before making health, medication, or treatment decisions. Results from our tools reflect the answers you give and are a starting point for practical changes, not a professional evaluation.
4. Informed consent for assessments, experiences, and events
When you take an assessment or audit, join a workshop, experience, event, or sensory space, or use our audio and media, you understand and agree that:
- Participation is voluntary. You can skip any question, pause, or stop at any time.
- Assessments rely on self-reported information and observation. They don't diagnose any condition and don't certify legal compliance.
- Reflective, sensory, movement, or mindfulness activities can sometimes bring up strong feelings or physical discomfort. Go at your own pace, adapt or skip anything, and talk to your health provider first if you have concerns.
- You're responsible for supervising children and anyone in your care during activities and with products.
- For group programs, please keep what others share private. We can't guarantee every participant will.
5. Accessibility services are not legal certification
Our accessibility, sensory, and readiness reviews offer practical recommendations. They are not legal advice and not a certification of compliance with the ADA, WCAG, Section 504, or any other law or standard. Consult qualified legal counsel for compliance decisions.
6. Purchases and pricing
Prices are in US dollars and shown before you pay. Payments are processed by Stripe or our shop's checkout provider. Sales tax is added where required. We may change prices for future purchases at any time.
- Digital products (assessments, reports, toolkits, printables, templates, downloads, and online tools) are delivered instantly. Because the value is delivered immediately, they're non-refundable once access is unlocked, except where we charged you in error, you never received access, or a problem on our side prevents use and we can't fix it. Contact us within 30 days of the charge.
- Subscriptions and memberships renew automatically each billing period until you cancel. Cancel any time from your account or by contacting us; access continues to the end of the paid period, without partial refunds.
- Consulting, assessments, trainings, and implementation projects are governed by the proposal, statement of work, or agreement you accept, which sets out scope, fees, payment schedule, rescheduling, and cancellation terms.
- Events and workshops follow the refund and transfer terms shown on the event listing.
- Physical products from our shop at mindfulspc.com follow the shop's return and refund policy. Made-to-order items are replaced or refunded if they arrive damaged, misprinted, or lost; supplier-shipped items follow the supplier's return terms shown on the product page.
7. Your account
Keep your sign-in details private and tell us if you think someone else has accessed your account. You're responsible for activity under your account.
8. Our content and your license
Our content, including text, assessments, frameworks, audio, video, designs, logos, and downloads, belongs to Mindful Innovations or our licensors and is protected by copyright and trademark law. When you buy or download something, you get a personal, non-transferable license to use it for its intended purpose: personally, or inside your own organization if you bought an organization option. You may not resell, redistribute, publish, or use our materials to train AI models, or remove our credits, without written permission. Organization-wide, multi-site, white-label, or licensing uses need a separate written license.
Audio and media hosted on other platforms (such as Insight Timer or Aura) stay subject to those platforms' terms.
9. What you share with us
You keep ownership of what you submit. You give us permission to use it to provide and improve the Services. Please don't submit anything unlawful, anything you don't have the right to share, or health information through general forms. If you send us feedback or ideas, we may use them without obligation to you.
10. Acceptable use
Don't misuse the Services: no interfering with security or operation, scraping or bulk copying, reverse engineering paid tools, impersonating others, or using the Services to harass or harm anyone.
11. Third-party services and links
We link to and rely on other services (for example Stripe, Ecwid, Kit, Insight Timer, Aura, and suppliers). We're not responsible for their content, policies, or availability.
12. Disclaimers
We work hard to make our Services helpful and accurate, but we provide them "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We don't guarantee particular results from any assessment, recommendation, product, or program.
13. Limitation of liability
To the fullest extent the law allows, Mindful Innovations won't be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim related to the Services is limited to the amount you paid us for the specific product or service in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
14. Indemnity
If you misuse the Services or break these Terms and that leads to a claim against us, you agree to cover our reasonable costs of that claim.
15. Governing law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Ramsey or Hennepin County, Minnesota, unless the law requires otherwise. Before filing a claim, please contact us so we can try to resolve it informally.
16. Changes
We may update these Terms. We'll change the date above and, for meaningful changes, give notice on the site or by email. Using the Services after changes take effect means you accept them.
